 Realty Point accuses Ogun officials, Amotekun of trespass, defiance of Court orders at Pakuro Scheme 1

Fresh controversies have continued to trail the ownership and control of Pakuro Scheme 1, a 76.15-acre estate owned by Realty Point Limited in Ijere, Obafemi Owode Local Government Area of Ogun State, as the company accuses officials of the Ogun State Government, the Town Planning Authority, and Amotekun operatives of “lawlessness, trespass, and flagrant disregard for court orders.”
The Managing Director/CEO of Realty Point Limited, Mr. Debo Adejana, and Dr. Gbenga Eretan, the company’s legal counsel, made this known during a press conference held in Lagos.

Adejana has raised serious concerns over what he described as the “continuous and unlawful invasion” of the company’s estate.

He said that despite a subsisting interim injunction granted on 28 July 2025 by the Chief Judge of Ogun State, Hon. Justice M. A. Dipeolu, restraining all defendants, including the Ogun State Planning and Permit Authority and the Ogun State Government with all its agents, from taking any action on the disputed land pending the hearing of an interlocutory application, government-backed operatives have continued to act in total disregard of the court.
According to him, the claim that the Town Planning Authority authorized Amotekun operatives to access the land is already before a court, yet the security outfit has repeatedly returned to the site.

He stated that their actions “send a strong message that they consider themselves above the law and untouchable.”

Adejana further disclosed that following the approval of the Inspector General of Police, Kayode Egbetokun, the AIG at Alagbon deployed police squads who arrested some individuals on the site last Tuesday.

He noted that the suspects are undergoing prosecution, and the company had expected that the legal process would deter further unlawful activities.

“But to our shock, we have credible information that the site was still invaded afterward,” he said.

He questioned the legal basis for Amotekun’s involvement in a civil land matter, insisting that the outfit has no statutory powers in land disputes.

“I don’t know when Amotekun became a law enforcement body with authority to intervene in land matters,” he stated.

Adejana warned that the continued occupation and construction activities on the land, despite the clear court order, could provoke serious community conflict.

“If we were not law-abiding citizens, and if the villagers were not restrained, what they are doing is capable of triggering a community war.

You cannot forcefully take over someone’s land and behave as though the rightful owners can ‘go to hell,’ which is exactly the message being sent.”

He alleged that those behind the invasion boast openly about having powerful connections and political backing.

“We are shocked. We don’t understand when friendships, political alliances, or personal influence became a legitimate basis for claiming ownership of land.”

Adejana reaffirmed that Nigeria’s land tenure system and the Land Use Act are unambiguous.

He stressed that all parties must respect the law and the authority of the courts. “Legality must be adhered to.

They need to vacate the site. Regardless of their grievances, the court remains the only lawful arbiter.

That is why the judicial system exists, and we are prepared to meet them there.”

Adejana stressed that Pakuro Scheme 1 is not an empty land but a fully marketed real estate project, plots have been sold and allocated to buyers.

According to him, buildings erected since 2013/2014 already stand on parts of the estate, adding that the ongoing attempts to seize the land put investors and homeowners at serious risk.

Providing legal clarity on the root of the dispute, Dr. Gbenga Eretan, counsel to Realty Point Limited, outlined the company’s chain of title and court victories at multiple judicial levels.

Dr. Eretan explained that Realty Point purchased the land from members of the Ogundimu and Akinyemi Ogundimu families, including Rev. Olatunji Abiodun, Mr. Kashimawu Shodiya, and Mr. Leafeez Ololade.

These families, he said, were the original owners.

Another family, led by Joshua Alejolowo of the Orunmakinde family, contested the ownership and took the matter to the Ogun State High Court.

He noted that the Ogun State High Court ruled in favour of the Ogundimu/Akinyemi families, from whom Realty Point purchased.

In January 2023, the Court of Appeal (Case No. CA-IB-226-2015) affirmed the High Court judgment, declaring the Ogundimu/Akinyemi families the rightful and bona fide owners of the entire disputed land.

Dr. Eretan emphasized that no appeal has been filed at the Supreme Court, and the 90-day appeal window expired long ago.

“As we speak today, the Court of Appeal judgment is extant, final, and enforceable. No one has approached either the Court of Appeal or the Supreme Court to set it aside,” he stated.

Dr. Eretan accused individuals laying claim to the land of using unlawful force to take possession.

According to him, some police officers admitted they were bribed to guard the land.

Guns and ammunition were found with them without proper assignment.

Forest guards were similarly armed without a license, indicating deliberate weaponisation.

After the arrests, the trespassing group allegedly recruited Amotekun to continue protecting the land.

“If someone has a lawful claim to land, they do not need to recruit armed men through the back door. These are unlawful means of taking land.

“Under what law is Amotekun empowered to protect land that is under litigation or already adjudged? This is a misuse of state apparatus.”

Eretan revealed that the disputing parties had met with the Ogun State Attorney General, who reportedly instructed all parties to maintain the status quo pending resolution.

However, he alleged that the warning was ignored, “Behind us, they went back to the land and resumed activities, even after acknowledging the court order and receiving our title documents,” he said.

Eretan said the company would now proceed with Form 48 and Form 49 applications, initiating contempt of court proceedings against all individuals or agencies breaching the injunction, including Amotekun operatives if necessary.

“If the court orders that they be arrested or detained for contempt, we will take that order to the police. No one is above the law,” he said.
