The Nigerian Electricity Regulatory Commission (NERC) has issued orders of transfer of oversight of Plateau State’s electricity market to the Plateau State Electricity Regulatory Commission (PSERC), making it the 11th state to assume control of its electricity market.

This decision was outlined in a statement released by NERC, and obtained by Advisors Reports, on Friday.

The statement confirmed that Jos Electricity Distribution Plc (JED) has been granted the right to complete the incorporation of a subsidiary, JED SubCo, within 60 days from March 12, 2025.

The transfer process is expected to be fully completed by September 12, 2025.

NERC clarified that while PSERC will assume regulatory responsibility for Plateau State’s intrastate electricity market, the Commission will retain oversight as a central regulator for interstate and international generation, transmission, supply, trading, and system operations, as specified in the Electricity Act 2023.

The Commission also noted that the Plateau State Government met all the legal requirements for the transfer, formally notifying NERC and requesting the shift of regulatory oversight.

It further said, “As part of the process, JED has been directed to establish JED SubCo to handle intrastate electricity supply and distribution in the state.

“The subcompany must apply for and obtain a license for these activities from the Nigerian State Electricity Regulatory Commission (NSERC) following its incorporation,” NERC said.

Advisors Reports gathered that of March 14, 2024, NERC has successfully transferred electricity market oversight to eleven states.

Out of the eleven states, Enugu, Ekiti, Ondo, Imo, and Kogi have formally taken over regulatory oversight of their electricity markets based on the orders and fully assumed control.

Meanwhile, Oyo, Edo, Lagos, Ogun, and Niger have also been granted regulatory transfer orders but have until July 2025 to complete the transition.

Advisors Reports’ check showed that the states are currently in the process of finalizing the necessary legal and operational structures to take full charge of their respective electricity markets.
